1. Who is responsible for your data
VivendaNova is the trading name of Grupo PriveCom Soluciones, S.L., NIF B09958307, registered address Calle Anselm Clavé 63, Local 2, 17300 Blanes (Girona), Spain. Office: Avenida Alegries 6, local, 17310 Lloret de Mar (Girona). For anything about your personal data, write to info@vivendanova.com or call +34 600 620 806.
2. What we collect
- What you send us in a form: name, email, phone or WhatsApp number, country, preferred language, the property you are asking about and your message.
- Conversations: the messages, voice notes and files you send us on WhatsApp or by email.
- Where you came from: the campaign parameters in the link you clicked (for example utm_source, utm_campaign or fbclid) and the page you were on.
- How the site is used: pages viewed, device, browser and approximate location from your IP address, collected through cookies as described in our cookie policy.
3. Why we use it and on what legal basis
- To answer you, send the information you asked for and arrange calls or viewings: steps taken at your request before a contract (Art. 6(1)(b) GDPR).
- To follow up on your search with properties that match what you told us, for as long as you are looking: our legitimate interest in continuing a conversation you started (Art. 6(1)(f) GDPR). You can ask us to stop at any time.
- To send our newsletter: only with your consent, given by ticking the box in a form (Art. 6(1)(a) GDPR). Every email has an unsubscribe link.
- To measure our advertising and show our properties to people with similar interests on Facebook and Instagram: through cookies and the Meta Conversions API (see the cookie policy).
- To meet our legal obligations as an estate agency, including anti-money-laundering checks if a purchase goes ahead (Art. 6(1)(c) GDPR).
4. Our AI assistant on WhatsApp
Messages to our WhatsApp number +34 663 389 684 are answered first by Emilia, an AI assistant, and she says so in her first message. She answers questions about our properties and the buying process and helps arrange a call or a viewing. Our team sees every conversation and takes over whenever you ask for a person or the question needs one. Voice notes are transcribed automatically so that she can read them. Emilia does not take any decision that has legal or similarly significant effects on you.
5. Who receives your data
We share data with providers who process it on our behalf and under contract, and only what each one needs. For the Meta Pixel and the Conversions API, Meta Platforms Ireland Ltd. is a joint controller. The notary and the institutions involved in a purchase handle data as independent controllers:
- Hostinger: website hosting, email and newsletter sending.
- Google: Analytics, Tag Manager, reCAPTCHA (spam protection on forms) and Google Workspace.
- Meta Platforms: WhatsApp Business, the Meta Pixel and the Conversions API for Facebook and Instagram advertising.
- Zernio: the platform that connects our WhatsApp number to our client management system.
- Anthropic: the AI model behind our WhatsApp assistant.
- ElevenLabs: automatic transcription of WhatsApp voice notes.
- Our lawyer, notary and bank: only if you decide to go ahead with a purchase, and only what the transaction needs.
We also share data with public authorities when the law requires it.
6. Transfers outside the European Economic Area
Some of these providers are based in the United States. Transfers rely on the EU-US Data Privacy Framework (European Commission decision of 10 July 2023) where the provider is certified under it, or on the European Commission’s standard contractual clauses. You can ask us for a copy of the safeguards at info@vivendanova.com.
7. How long we keep it
We keep enquiries while we are in contact about a property and for up to three years after our last contact, so that we can pick up the conversation if you come back to us. Newsletter data is kept until you unsubscribe. If a purchase goes ahead, transaction records are kept for as long as Spanish law requires, including anti-money-laundering rules. You can ask us at any time to delete your data sooner, except where the law requires us to keep it.
8. Do you have to give us your data?
No. But we need a name and at least one way to contact you to answer an enquiry. Without them we cannot reply.
9. Your rights
You can ask to access your data, correct it, delete it, restrict or object to its use, receive it in a portable format and withdraw any consent at any time, without affecting the lawfulness of processing before you withdrew it. Write to info@vivendanova.com. We answer within one month.
If you think we have not handled your data properly, you can complain to the Agencia Española de Protección de Datos, C/ Jorge Juan 6, 28001 Madrid, www.aepd.es, or to the data protection authority of your EU country of residence.
10. Changes to this policy
If we change how we handle personal data, we will update this page and the date at the top.
